M1 Concourse, LLC ("M1 Concourse," "we," "our," or "us") operates a premier motorsports venue and events destination located in Pontiac, Michigan. Our property encompasses multiple facilities and spaces, including the X Center, the Event Center, the Prefix Performance Center, and various public-access areas such as gathering spaces, race tracks, and surrounding grounds. Some areas of our property may be used for private events. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you interact with us — including through our website at M1Concourse.com, our mobile application, event registrations, membership programs, and on-site presence.

Please review this Privacy Policy carefully. This Privacy Policy is a notice describing our information practices; it is not a contract and does not create contractual rights or obligations. Your access to and use of our website, mobile applications, venues, and services are governed by our Terms and Conditions, which incorporate this Privacy Policy by reference.

Notice of Photography and Recording. M1 Concourse property — including all venues, tracks, gathering spaces, and surrounding grounds — is regularly photographed, filmed, and recorded by us and our authorized partners during both public and private events, and guests, participants, exhibitors, competitors, and visitors may be captured in that media. Such media may be used for marketing, advertising, sponsorship, promotional, and other commercial purposes. Consent to this capture and use is obtained through conspicuous signage posted at property and venue entrances, our Terms and Conditions, and the ticketing, registration, membership, and waiver terms you accept when purchasing tickets or participating in our events or programs. Any individual (including a minor, through a parent or legal guardian) who will be featured individually or prominently in advertising or sponsorship materials will be asked to sign a separate written media release. If you have questions about, or wish to object to, the use of your image or likeness, please contact us as described in Section 10.

1. Information We Collect

We collect personal information in the following contexts:

a. M1 Concourse App (Powered by App My Community)

The M1 Concourse App is our general-access mobile application available to all guests, visitors, and community members. It is built on the App My Community platform, operated by Armstrong Software, LLC (d/b/a App My Community), and covers the full M1 Concourse property experience — including the X Center, Event Center, Prefix Performance Center, and all on-site venues and spaces. When you use the M1 Concourse App, we and/or App My Community may collect:

• Personal identifiers: name, email address, and location
• Account credentials including username and password
• Usage data generated while using the application (e.g., activity history, preferences, in-app interactions, and requests submitted through the app)
• Device information such as device type, operating system, and unique device identifiers

Information you submit through the app may be shared with M1 Concourse so that we can respond to requests, manage reservations or purchases, or send communications. App My Community (Armstrong Software, LLC) maintains its own privacy practices as the platform provider. b. X Center App (Powered by Ideal Systems)

The X Center App is a separate mobile application designed exclusively for the X Center experience at M1 Concourse, built on the Ideal Systems (Ideal Amusement Software) platform. When you use the X Center App, we and/or Ideal Systems may collect:

• Personal identifiers: name, email address, phone number
• Account credentials and profile information
• Usage data generated while using the application (e.g., activity history, preferences, in-app transactions, and interactions within the X Center experience)
• Device information such as device type, operating system, and unique device identifiers
• Transaction and payment information processed through the app

c. X Center Reloadable Card

M1 Concourse issues reloadable cards for use at X Center attractions and dining. In connection with these cards, we may collect or generate:

• Card account number and associated balance or transaction history
• Purchase and usage activity tied to the card
• Personal information linked to a card account if registered by the cardholder

Please note the following terms governing X Center reloadable cards: All sales are final. Cards are not redeemable for cash, and no refunds or exchanges will be issued. M1 Concourse and M1 X Center are not responsible for lost, stolen, or damaged cards. Cards are valid only at M1 X Center for attractions and dining, and are not valid at private events. d. Event Registrations & Ticketing

When you register for an event, purchase tickets, or sign up as an exhibitor or competitor through our ticketing platform (Vivenu), we may collect:

• Full name, email address, phone number, and mailing address
• Vehicle information (make, model, year, class)
• Payment and billing details (processed securely by our payment processor)
• Emergency contact information
• Participant or exhibitor category and credential details

e. Membership & Club Programs

If you inquire about or join an M1 Concourse membership or garage club program, we may collect:

f. Email & SMS Marketing

When you opt in to receive communications from us, we collect your email address and/or mobile phone number. You may opt out of emails at any time by clicking "Unsubscribe" in any email, or opt out of SMS messages by texting STOP to our designated number (see SMS Terms below).

g. Partner & Sponsor Inquiries

When businesses or individuals contact us regarding sponsorships, partnerships, or vendor opportunities, we collect company name, contact person, email, phone number, and relevant business details.

h. E-Commerce & Online Purchases

When you make purchases through our online store (powered by WooCommerce and/or Shopify) or complete transactions via Stripe, we may collect:

• Name, billing address, and shipping address

• Payment card details (processed and encrypted by Stripe; M1 Concourse does not store full card numbers)

i. Surveys & Feedback

When you respond to surveys sent via SurveyMonkey, we collect your responses and any contact information you voluntarily provide. Survey participation is optional.

j. On-Site Presence & Media Capture

When you visit M1 Concourse property — including the X Center, Event Center, Prefix Performance Center, and all public and private event spaces — we or our authorized partners may collect:

• Photography and video footage captured during events, track days, or general venue operations
• Security and surveillance footage collected for safety and operational purposes
• Information collected in connection with private events, including registration lists or check-in records provided by event organizers
• Likeness, image, and voice as captured in media produced on or around M1 Concourse property

Notice of this collection and its use for the marketing, sponsorship, advertising, and promotional purposes described in Section 2 is provided through this Privacy Policy, conspicuous on-site signage, and the Terms and Conditions and event registration, ticketing, and waiver terms described above; written media releases are obtained from individuals featured individually or prominently in advertising or sponsorship materials. To ask that we discontinue using your identifiable image in our marketing materials, or to exercise the rights described in Sections 7 and 8, contact us as described in Section 10; please note that we may be unable to recall media that has already been published or distributed. Use of M1 X Center facilities, including reloadable cards, is also subject to X Center facility rules and the card terms described in Section 1c above.

k. Website & Analytics

When you visit our website, we automatically collect certain technical data, including:

2. How We Use Your Information

3. SMS Terms

SMS Terms: When you opt in to receive text messages from M1 Concourse, which may include but are not limited to notifications, marketing, advertisements, invitations, and links, you agree that receiving text messages is not a requirement for purchase and may be charged standard data and message rates by your phone service provider. You may halt all text message communications by texting STOP to the designated marketing SMS number at any time. Text HELP for help and START to opt back in. Frequency of messages sent will vary. End user information is used for communication regarding marketing and advertising.

4. Sharing Your Information

We do not sell your personal information in exchange for money. However, like many businesses, we use third-party advertising and analytics cookies and pixels (described in Section 5), which may result in the disclosure of certain personal information (such as identifiers and internet activity data) to advertising partners. Event registration data is generally retained for three (3) years following the applicable event, unless a longer period is required by law or needed to resolve a dispute. Event registration data is generally retained for a minimum of three (3) years. Marketing opt-in records are retained for the duration of the relationship plus any legally required period thereafter.

Security. We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, and destruction, appropriate to the nature of the information and our operations. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. In the event of a security incident affecting your personal information, we will provide notice as required by applicable data breach notification laws.[

• Opt Out of Profiling: Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. We do not engage in this type of profiling.
• Limit Use of Sensitive Personal Information (California): As described in Section 8(a), we do not use or disclose sensitive personal information for purposes that would trigger this right.
• List of Third Parties (Oregon): Oregon residents may request a list of the specific third parties to which we have disclosed personal information.
• Non-Discrimination: We will not discriminate or retaliate against you for exercising your rights, and we do not currently offer financial incentives in exchange for personal information.

d. How to Exercise Your Rights

You (or, where permitted, your authorized agent) may exercise these rights by emailing us at info@m1concourse.com with the subject line “Privacy Rights Request,” or by writing to us at the address in Section 10. Please state your name, your state of residence, the right(s) you wish to exercise, and sufficient information for us to locate your records. We will verify your identity before responding to access, correction, deletion, or portability requests, which may require matching information you provide against information we maintain; we do not require verification for opt-out requests, though we may ask for information necessary to complete the request. If you use an authorized agent, we may require proof of the agent’s written authorization and verification of your identity. We will respond within 45 days (or such other period required by your state’s law), and may extend that period once by an additional 45 days where reasonably necessary, in which case we will notify you. We will not charge a fee to process a request unless permitted by applicable law.

e. Opting Out of Cookies, Sale, Sharing, and Targeted Advertising

To opt out of the “sale” or “sharing” of your personal information and “targeted advertising” carried out through cookies and pixels, you may: (i) use the cookie preference tool available on our website (including the “Your Privacy Choices” / “Do Not Sell or Share My Personal Information” link in our website footer) to disable advertising and other non-essential cookies; (ii) enable an opt-out preference signal, such as the Global Privacy Control (GPC), in your browser or browser extension, which we will treat as a valid opt-out request for that browser or device; or (iii) contact us as described in Section 8(d). Because cookie-based opt-outs are specific to the browser and device you are using, you will need to renew your preferences if you clear your cookies or use a different browser or device.

f. Right to Appeal

If you are a resident of a state other than California and we decline to take action on your request, you may appeal our decision by replying to our response or emailing info@m1concourse.com with the subject line “Privacy Rights Appeal.” We will respond to your appeal within the period required by your state’s law (generally 45 to 60 days) with a written explanation of the reasons for our decision. If your appeal is denied, you may contact your state Attorney General to submit a complaint.

g. Additional Disclosures for California Residents

Retention. We retain each category of personal information described above for the periods stated in Section 6, determined by the criteria described there (the length of our relationship with you, our legal and contractual obligations, and the purposes for which the information was collected).

Shine the Light. California Civil Code § 1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for their own direct marketing purposes. To make such a request, contact us using the information in Section 10.
